Aereus Technologies Inc.

On August 1, 2023, Aereus Technologies Inc. filed a Notice of Intention to Make a Proposal (“NOI”) under Section 50.4 of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3, as amended (the “BIA”), and B. Riley Farber Inc. (“B. Riley Farber”) was appointed as proposal trustee in the Companies’ NOI proceedings (in such capacity, the “Proposal Trustee”).

Status Updates

On August 8, 2023, an Order (the “DIP Financing and Priority Charges Order“) was issued by the Superior Court of Justice (Commercial List) (the “Court“) approving, among other things, the extension of the time for filing a proposal with the Official Receiver, including the stay of proceedings, up to and including September 22, 2023.

On September 21, 2023, an Order (the “Assignment, Approval and Vesting Order“) was issued by the Court approving, among other things, the extension of the time for filing a proposal with the Official Receiver, including the stay of proceedings, up to and including October 6, 2023.
