On September 17, 2013, an Order was made by the Honourable Mr. Justice Brown pursuant to Section 243(1) of the Bankruptcy and Insolvency Act, R.S.C. 1985, c. B-3, as amended and Section 101 of the Courts of Justice Act, R.S.O. 1990, c. C.43, as amended appointing B. Riley Farber Inc. (“B. Riley Farber“) as Receiver, without security, of all the assets, undertakings and properties of Rev Sleep Corporation and 2153879 Ontario Inc. (collectively, “Rev Sleep“) acquired for, or used in relation to a business carried on by Rev Sleep, including all proceeds thereof for the primary purpose of effecting a sale of substantially all of Rev Sleep’s rights, titles and interests in its business and property to Sommex Bedding Corporation. A copy of the Court Order and Endorsement, both dated September 17, 2013, are posted below.
Status Updates
Also on September 17, 2013, an Approval and Vesting Order was made by the Honourable Mr. Justice Brown approving a sale transaction between the Receiver and Sommex Bedding Corporation. A copy of the Approval and Vesting Order and the Reasons for the decision are also posted below.
