Jolian Investments Limited (“Jolian“) filed a Notice of Intention to Make a Proposal (“NOI“) pursuant to the provisions of the Bankruptcy and Insolvency Act (“BIA“) on June 26, 2017, and B. Riley Farber Inc. (“B. Riley Farber“) was appointed as Proposal Trustee.
Although the NOI proceeding is pursuant to the BIA, it is important to note that the Company is not bankrupt.
Status Updates
The effect of the Notice of Intention to Make a Proposal is that it provides an initial 30-day stay over all creditors for all amounts outstanding effective June 26, 2017 (i.e. all amounts outstanding at June 26, 2017, and prior) whilst the Company formulates a Proposal to be presented to its creditors.
Please find below a copy of the Certificate of Filing a Notice of Intention to Make a Proposal and the Notice of Intention Package sent to creditors on June 27, 2017. Additional information will be posted as it becomes available.
On July 26, 2017, by Order of the Honourable Justice Penny, the deadline to file a Proposal was extended by 45 days to September 9, 2017.
On September 5, 2017, by Order of the Honourable Justice Myers, the deadline to file a Proposal was extended by another 45 days to October 24, 2017.
