On February 24, 2022, by Order (the “Appointment Order”) of the Ontario Superior Court of Justice (Commercial List) (the “Court“) pursuant to section 243(1) of the Bankruptcy and Insolvency Act (“BIA“), B. Riley Farber Inc. (“B. Riley Farber“) was appointed as Receiver (in such capacities, the “Receiver“), without security, of all of the assets, undertakings and properties of Net Zero Renewable Energy Inc. (“Net Zero” or the “Debtor“) acquired for, or used in relation to a business carried on by the Debtor, including all proceeds thereof (the “Property“).

Status Updates
On February 24, 2022, the Court issued an Order (the “Debenture Order“) declaring:
- that Horizon RE Limited (the “Applicant“) together with Wilmot Matthews, Donald K. Johnson, Cumberland Private Wealth Management Inc. and Connor Corp. (collectively, the “Remaining Holders“) collectively hold 100% of the outstanding Series 1 Debentures and Series 2-1 Debentures;
- that the Applicant is hereby authorized and empowered to bring this Application pursuant to Section 9.5 of the Indenture.
