On March 31, 2023, by Order (the “Receivership Order”) of the Court of King’s Bench of Alberta (the “Court”), pursuant to section 243(1) of the Bankruptcy and Insolvency Act, R.S.C 1985, c. B-3 (the “BIA“), section 13(2) of the Judicature Act, R.S.A. 2000, c. J-12, section 65(7) of the Personal Property Security Act, R.S.A. 2000, c. P-7, section 54 of the Prompt Payment and Construction Lien Act, R.S.A. 2000, c. P-26.4 (the “Lien Act“), and section 49(1) of the Law and Property Act, R.S.A. 2000, c. L-7, B. Riley Farber Inc. (“B. Riley Farber“) was appointed as receiver (the “Receiver“), without security, of all of 2101705 Alberta Inc. and Lukus Developments Inc.’s (collectively, the “Debtors“) current and future interests in:
(a) the lands and premises legally described as CONDOMINIUM PLAN 0810165, UNIT 86, AND 57 UNDIVIDED ONE TEN THOUSANDTH SHARES IN THE COMMON PROPERTY, EXCEPTING THEREOUT ALL MINES AND MINERALS (“Unit 86“);
(b) the lands and premises legally described as CONDOMINIUM PLAN 0810165, UNIT 153, AND 57 UNDIVIDED ONE TEN THOUSANDTH SHARES IN THE COMMON PROPERTY, EXCEPTING THEREOUT ALL MINES AND MINERALS (“Unit 153“);
(c) the lands and premises legally described as CONDOMINIUM PLAN 0810165, UNIT 154, AND 57 UNDIVIDED ONE TEN THOUSANDTH SHARES IN THE COMMON PROPERTY, EXCEPTING THEREOUT ALL MINES AND MINERALS (“Unit 154“);
(d) the lands and premises legally described as CONDOMINIUM PLAN 0810165, UNIT 166, AND 57 UNDIVIDED ONE TEN THOUSANDTH SHARES IN THE COMMON PROPERTY, EXCEPTING THEREOUT ALL MINES AND MINERALS (“Unit 166“, and collectively with Unit 86, Unit 153, and Unit 154, the “Lands“);
(e) all of the Debtor’s current and future assets and undertakings and properties of every nature and kind whatsoever, and wherever situate, including all proceeds thereof, pertaining to or relating to such Lands and all rents, deposits, bank accounts, and other amounts associated with such Lands; and;
(f) all books and records, rights, renewal rights, contracts, agreements, licenses or permits in favour of or held by the Debtors with respect to the Lands,
(collectively, the “Property“).
